GENERAL TERMS OF HIRE CARS
1. The client declares receipt of the specified vehicle named in the contract and agrees it was consigned in a good state of maintenance and that he/she has inspected the vehicle and has verified it to be in working order as regard in particular to the main systems: brakes, lights, indicators etc. The client declares that he/she received the vehicle with a full tank of petrol, if not otherwise stated on the contract and that it was equipped with all the necessary documentation, green card, spare tyres etc. 2. The rental company will reimburse the client for any repair works that may occur during the period of rental as long as the costings have been agreed to by the rental company and that the work done is supported by the necessary documentation. 3.The client accepts that the vehicle is covered by a comprehensive RCA policy covering Fire, Theft, Casco and acts of vandalism. For Casco and acts of vandalism the insured is liable for up to 10% of the loss or a minimum of € 516,46 for Casco and € 154,94 for acts of vandalism. The client agrees to reimburse the rental company, the sum of the excess (10%) of the loss, in case of a loss, and he/she will therefore leave a deposit to cover the above sum, with the rental company - which will be refunded on return of the vehicle once it has been ascertained that it is undamaged. 4. The client undertakes to drive and to maintain the vehicle and its accessories with care within the rules of the highway code, in particular: Normal maintenance, lubricant checks and brake oil. The client will pay for any penalties or fines received during the rental period thereby exonerating the rental company of all involvement. The client must ensure that only the driver/s named on the contract are allowed to drive the car. The client will not drive the car in the following countries where the green card insurance does not apply: Albania, Bulgaria, ex URSS, Czech republic, Poland, Rumania, Slovacca republic, Hungary, Ex Yugoslavia, Greece, Ukraine, Morocco, Algeria,Tunisia. The client will not sub-contract the vehicle to another party. The client will not use the car to push or tow other objects. The client will not drive under the influence of drugs, narcotics, alcohol or intoxicating substances The client will not race the car or take part in competitions etc. 5. Should the client be involved in an accident, he/she is obliged to: Immediately contact the rental company and within 24 hours submit to them the relevant completed forms (included in the rental pack). This should be done manually or by fax 0577940201. Inform the nearest police station. Under no circumstances admit liability. Take the name and address of the other driver/s involved in the accident as well as any witnesses. Inform the rental company of any other important details. Follow the rental company's instructions on accident procedures. 6. The client will return the vehicle to the rental company at the designated place and by the time agreed on the contract, and in the same state and with its accessories intact. If the vehicle is not returned by this date the rental company can repossess the vehicle by any means deemed necessary, even against the wishes of the client, who will be expected to pay any resulting expenses. 7. The client is obliged to pay the rental company, the established price for the rental which is calculated on time, the expected use being 150 kms in a 24 hour period. If this is exceeded the client will be charged € 0,18 for every extra km over the above mentioned limit. The tariff per km is worked out on the car mileage, therefore the client is expected to check periodically that the speedometer is working, and should there be a defect, to communicate this immediately to the rental company and to respect the procedural instructions laid out by the company. If, on the vehicle return, it is found to have a faulty or broken speedometer, the tariff will be calculated on a use of 250kms per day. The daily rental calculation will be based on the 24 hours of each day of use, incepting at the time of the original consignment of the vehicle. (i.e. 5pm Monday to 5pm Tuesday = 24 hours.) 8. The rental company is not liable for any eventual costs or damages that the client or a third party may incur as a result of breakdown, accident, robbery, riot, etc. Any belongings left in the vehicle after its reconsignment will be considered abandoned and the rental company is not obliged to keep or return them to the client. 9. The rental company reserves the right to not rent the vehicle if the client has held a license for less than 2 years and/or is under 21 years of age. 10. Any litigation will be referred to the tribunal in Siena. 11. No modifications will be made to the general conditions of the rental contract without authorisation of the rental company. 12. The Italian text of terms and conditions overules the English text in case of a discrepancy in translation.
